Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and PermitPulse LLC (“PermitPulse,” “we,” “us”) governing your access to and use of the PermitPulse website and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

PermitPulse provides email alerts and a searchable feed of pending Texas air permit applications and related activity, based on public records published by the Texas Commission on Environmental Quality (TCEQ). We may change, suspend, or discontinue any part of the Service at any time.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 and able to form a binding contract. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and cancellation

• Paid plans are billed in advance on a recurring basis through our payment processor (Stripe) at the price and interval shown at checkout. Subscriptions automatically renew until cancelled.
• You may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
• Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused time.
• We may change prices; changes apply to the next billing period after reasonable notice. Taxes may apply.

4. Acceptable use

You agree not to:

• scrape, harvest, resell, or systematically extract the Service or its data except as expressly permitted;
• share, sublicense, or provide your account access to others outside your plan;
• interfere with, overload, or attempt to gain unauthorized access to the Service;
• use the Service to violate any law or the rights of others.

5. Intellectual property

The Service, including its software, design, and original content, is owned by PermitPulse and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes in accordance with these Terms. Underlying permit records are public information sourced from TCEQ.

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

PermitPulse is an independent service and is not affiliated with, endorsed by, or sponsored by TCEQ. Permit information is aggregated from public records and may be incomplete, delayed, or inaccurate; the authoritative source is TCEQ. The Service does not provide legal, engineering, or other professional advice, and nothing in it should be relied on as a substitute for a qualified professional or for the official TCEQ record. You are responsible for independently verifying any information before relying on it.

7. Limitation of liability

To the fullest extent permitted by law, PermitPulse and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim will not exceed the greater of the amounts you paid us in the twelve (12) months before the claim or one hundred U.S. dollars ($100).

8. Indemnification

You will indemnify and hold harmless PermitPulse from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms.

9. Dispute resolution; binding arbitration

Please read this section carefully — it affects your legal rights. Except for claims that may be brought in small-claims court, you and PermitPulse agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, administered under the rules of a recognized arbitration provider, rather than in court. You and PermitPulse waive the right to a jury trial and to participate in any class, collective, or representative action. Arbitration will take place in Harris County, Texas, or another mutually agreed location or by videoconference.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to Section 9, the exclusive venue for any permitted court proceeding is the state and federal courts located in Harris County, Texas.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (including Sections 5–10) will survive.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date; material changes may also be sent by email. Continued use after changes take effect constitutes acceptance.
